This website (nextstop.au) (the site) is run and maintained by NEXT STOP AUSTRALIA PTY LTD (Next Stop AU), a company registered in the Australia. Our company number is 660475963 and our registered office is at 27/32 King William Street, Melbourne, Australia 3065. Our email address is [email protected].

Next Stop Australia makes available an online recruitment platform, where candidates moving to Australia and local recruitment agencies are matched (the “Services”).

Applicants and Job Posters agree that when corresponding with each other, such correspondence will be done directly and as such any contracts, employment agreements and/or arrangements will be formed between the two parties. Next Stop London shall not be party to any such agreements, contracts or arrangements.

Next Stop Australia will not be held liable for your use of the site and / or our services and we do not accept any liability arising out of the same (save to the extent required by law), including the accuracy of recruiter or candidate profiles.

These website Terms and Conditions (Terms and Conditions) cover the terms on which you may use the site, conduct your business and purchase products.

Please read these Terms and Conditions carefully before you start to use the site. By using the site, you accept and agree to be bound and abide by these Terms and Conditions and our Privacy Policy. If you do not accept them, please do not use the site.

USER RIGHTS OF ACCESS

You have permission for temporary, non-exclusive use of the site. Next Stop Australia reserves the right to withdraw or change the content of the site and these Terms and Conditions at any time without notifying you and without having any legal responsibility towards you.

You are not allowed to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any part of the site.

You are also not allowed to license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the site and/or any documents or online resources on the site available to any third party.

You are responsible for configuring your own computer and software to access the material and content on our site including downloadable files. We do not warrant that the way we deliver data to you is compatible with your software or with the way your mobile device, computer or tablet is configured. Although we do our best to protect our site, we are not responsible for any viruses, bugs or similar issues. We advise that you use your own virus protection software to protect yourself.

We do not save your credit card details or share customer details with any third parties and we follow our Privacy Policy in handling information about you. By using the site, you agree to us handling this information and confirm that data you provide is accurate.

We are the owner or licensee of all intellectual property rights in the site including any databases that hold relevant information about the site. They are protected by copyright or trademark registration and you may only use any such material and the documents in line with these Terms and Conditions and this paragraph specifically. If you do not use the materials in line with these Terms and Conditions and this paragraph specifically, you lose your right to use our site, and must destroy or return any copies of documents you have made of it or any part of it. We reserve all our rights conferred to us by law to remedy any such breach.

OUR RESPONSIBILITY TO YOU

We do not guarantee the accuracy of material on our site or the materials uploaded by our users, and you are responsible for the way you use its content.

We shall not limit or exclude our liability for:

Any duty of care owed to you by us is owed to you alone and no duty of care is owed to any third party and we do not assume any responsibility to any third party in respect of the performance of our duties to you.

LINKS TO OUR SITE OR OTHER SITES

You are allowed to make a link to our site’s homepage from your website if the content on your site meets the standards of our Acceptable Use Policy and provided you do not suggest any endorsement by us or association with us unless we provide agreement in writing. We reserve the right to end this permission at any time.

COMPUTER OFFENCES

If you do anything which is a criminal offence under the Computer Misuse Act 1990 (for example introducing viruses, worms, Trojans and other technologically harmful or damaging material) your right to use the site will end immediately, we will report you to the relevant authorities and provide them with details of your identity.

You must not try to obtain access to our server or any connected database or make any ‘attack’ on the site.

JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any matters arising in connection to this agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

This policy (together with website Terms and Conditions and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us (your “Information”).

WHAT INFORMATION DO WE USE?

Information you give us. This is information about you that you give us by filling in forms on our site nextstop.au (our site) or by corresponding with us by phone, e-mail or otherwise. It only includes basic personal data required for you to be able to use our site, subscribe to our service, participate in discussion boards or other social media functions on our site, enter a competition, promotion or survey upload your CV, upload your company details and when you report a problem with our site. HOW DO WE SHARE YOUR INFORMATION?

You acknowledge and agree that from time to time we have the right to share your personal information with:

Selected third parties including:

  • Craft for use of their service;
  • Mailchimp to send you our newsletter, if you consent;
  • PayPal (Europe) S.à r.l. et Cie, S.C.A. for processing payments;
  • Google LLC. for the storage of documents that include your personal data on Google Drive, the use of Gmail in order to contact you about any services we provide to you and Google Contacts to store and maintain our clients’ details;
  • Xero Limited, to issue our clients with invoices for services we provide them with;
  • business partners, suppliers and subcontractors for the performance of any contract we enter into with you;
  • advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in Auckland).

We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience;

  • analytics and search engine providers that assist us in the improvement and optimisation of our site;

We will disclose your personal information to third parties:

  • In the event that you apply for a job, we will share your contact details and any supporting documentation you submit, such as your CV and / or evidence of your qualifications with the job poster;
  • In the event that you post a job, we will share your contact details with the candidates who apply for the job or who want to make an enquiry about it;
  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.
  • If NEXT STOP AUSTRALIA PTY LTD or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions and other agreements; or to protect the rights, property, or safety of NEXT STOP AUSTRALIA PTY LTD, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

HOW LONG DO WE KEEP YOUR INFORMATION FOR?

If you do not use Next Stop Australia or interact with our services for a significant period of time, we will delete some or all of your Personal Data from our site. Our criteria for deletion is determined according to the frequency of interactions observed and the nature of the Personal Data.

WHAT ARE YOUR RIGHTS?

If at any point you wish to know which Information we are processing about you, or if you do not wish for us to process your Information anymore or if you believe the Information we process on you is incorrect or obsolete you can request to see this Information and/or have it corrected or deleted by us by contacting the Data Protection Officer at [email protected].
